29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On December 10, 2024, at the above addressed jobsite, employees were exposed to a struck-by hazard from falling tools, material and debris when working below employees performing roofing work.  The employees were not wearing hard hats.  Ali Josue Correa Ortiz dba Pitufos Roofing LLC was previously cited for a violation of this occupational safety and health standard 1926.100(a), which was contained in OSHA inspection number 1688603, citation number 1, item number 1, and was affirmed as a final order on November 15, 2023, with respect to a workplace located at 1130 Ashley Road in Lake Forest, Illinois.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On December 10, 2024, at the above addressed jobsite, employee(s) performing roofing work on residential home, approximately 12 feet above the ground below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employee(s) to fall hazards.    b) On December 10, 2024, at the above addressed jobsite, employees performing roofing work on residential home, approximately 24 feet above the ground below, were not secured to a personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards.    Ali Josue Correa Ortiz was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1505117, citation number 1, item number 2, and was affirmed as a final order on February 1, 2021, with respect to a workplace located at 509 Saint James Court in Oak Brook, Illinois.  Ali Josue Correa Ortiz dba Pitufos Roofing LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1688603, citation number 2, item number 1, and was affirmed as a final order on November 15, 2023, with respect to a workplace located at 1130 Ashley Road in Lake Forest, Illinois. 29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On December 10, 2024, at the above addressed jobsite, the portable ladder used by employees to access and egress the roof over the front stoop, measuring approximately 14 feet from ground to the front peek, was not extended to have the side rails extend at least three (3) feet above the upper landing.    b) On December 10, 2024, at the above addressed jobsite, the portable ladder used by employees to access and egress the roof, measuring approximately 24 feet from ground to eve, was not extended to have the side rails extend at least three (3) feet above the upper landing.    Ali Josue Correa Ortiz was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(1), which was contained in OSHA inspection number 1505117, citation number 2, item number 1, and was affirmed as a final order on February 1, 2021, with respect to a workplace located at 509 Saint James Court in Oak Brook, Illinois.
