29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a). Peerless Stove & Manufacturing Company, Inc. DBA Peerless Ovens, on or about August 7, 2023, at the location of 334 Harrison Street, Sandusky OH: The employer failed to establish an energy control program that included elements such as periodic inspections, written procedures, and training. Employees performing die/tool changes at or near the point of operation on the equipment such as but not limited to the Amada PEGA 357 CNC Turret Punch and Cincinnati Mechanical Break Press were exposed to potentially hazardous energy exposing them to a crushing hazard.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck a). Peerless Stove & Manufacturing Company, Inc. DBA Peerless Ovens, on our about August 7, 2023, at the location of 334 Harrison Street, Sandusky OH: The employer failed to ensure that employees operating powered industrial trucks were adequately trained. Employees were operating forklifts to unload trucks and move product throughout the facility without the benefit of being adequately trained. Due to this condition employee working on or around forklifts were exposed to struck-by injuries, tipping, and rollover hazards.

DBA Peerless Ovens, on or about August 7, 2023, at the location of 334 Harrison Street, Sandusky OH: The employer failed to adequately guard the Cincinnati Mechanical Break Press flywheel approximately 5' from the ground. Due to this condition, employees operating the press in proximity to the flywheel while bending and forming sheet metal were exposed to a caught in hazard.
