29 CFR  1910.28(b)(11)(i):(i) Each employee exposed to an unprotected side or edge of a stairway landing that is 4 feet (1.2 m) or more above a lower level is protected by a guardrail or stair rail system;  On or about August 7, 2023, the employer failed to ensure the unprotected side or edge (right side when ascending) of the stairway landing leading to the Extruder Line No. 3 Pelletizer machine was equipped with a guardrail or stair rail system.  The Line No. 3 Pelletizer stairway landing was approximately 57 inches above the workshop floor.

29 CFR  1910.28(b)(11)(ii):(ii) Each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as follows:   On or about August 7, 2023, the employer failed to ensure the flight of stairs leading to the Line No. 3 Pelletizer machine was equipped with a stair rail system and/or handrail on the right side of the stairway when ascending.  The Line No. 3 Pelletizer stairway had 4 treads and 5 risers.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.   On or about August 7, 2023, the employer failed to ensure the Extruder Line No. 2 Feed (Screw) Auger was guarded to protect employees and operators from the rotating parts of the auger.

29 CFR  1910.303(b)(2):Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  On or about August 7, 2023, the employer failed to ensure the electrical receptacle (outlet) box used to power the 220V Extruder Line No. 2 vacuum pump was installed in accordance with the listed and labelled instructions.  The electrical receptacle box was designed for secured installation inside a wall or other fixture.

29 CFR  1910.305(g)(2)(iii):Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws.  On or about August 7, 2023, the employer failed to ensure the flexible cord connected to the electrical receptacle (outlet) box used to power the 220V Extruder Line No. 2 vacuum pump was provided with strain relief to prevent the conductors from being pulled from the receptacle outlet box.

29 CFR  1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about August 7, 2023, the employer failed to certify, with a certification that included the name of the operator, the date of training, and the date of the evaluation, that training and evaluation had been conducted for each operator of a powered industrial truck (forklift).
