29 CFR  1910.147(c)(4)(i):Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   On or about December 14, 2023, the employer did not ensure procedures were utilized for the control of potentially hazardous energy sources (electrical) when an employee was engaged in clearing obstructions (clearing jams) from the discharge chute of a feed mixer/blender machine, known as the Ribbon Blender B2.

29 CFR  1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  On or about December 14, 2023, the employer did not ensure the operator of a feed mixer/blender machine, known as the Ribbon Blender B2, performing service and maintenance activities by checking for obstructions (clearing jams) inside the discharge chute of the machine applied and followed the established energy control procedure by; turning off or shutting down the blender machine [per 1910.147(d)(2)], isolating the machine from the electrical energy source [(d)(3)], affixing lockout device(s) to the energy isolation device [(d)(4)(i), and verifying de-energization and isolation had been accomplished [(d)(6)], prior to reaching into the discharge chute to check for obstructions.

29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about December 14, 2023, the employer did not ensure that a mixer/blender operator permitted to operate a powered industrial truck (forklift) was competent to operate a powered industrial truck safely by the successfully completing training, evaluation, and certification to operate a forklift.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.   On or about December 14, 2023, the employer failed to ensure one or more methods of machine guarding was provided to protect the operator(s) of a feed mixer/blender machine, known as the Ribbon Blender B2 from the machine hazards created by the point of operation and rotating parts of the blender machine's mixing paddle agitator at the top of the machine and the bottom discharge chute.

29 CFR  1910.147(c)(7)(iv):The employer shall certify that employee training has been accomplished and is being kept up to date. The certification shall contain each employee's name and dates of training.  On or about December 14, 2023, the employer did not certify with each employee's name and date(s) of training that control of hazardous energy (lockout/tagout) training had been accomplished and kept up to date for employee working as blender machine operators.
