OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught-in hazards while operating presses that have unprotected foot pedals: A.) Industrial Sales and Manufacturing, North Building, on or about 10/12/23 and times prior thereto: Employees operated a Hurco PH 40-20 Hydraulic Press Brake that uses a foot treadle for actuation. The foot treadle was not protected from auction from falling or moving objects, or by inadvertent stepping on the food treadle bar exposing employees to the hazards of getting hands and fingers struck-by or caught-in the press brake point of operation. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: A.) Industrial Sales and Manufacturing, Main Building, on or about 10/12/23 and times prior thereto: employees were working around saws which did not have machine guarding in place to prevent employees from contacting moving blades. Employees can reach over the interlocked gate to contact the blade. Saws include but are not limited to, the Nishijimax NHC 100. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

B.) Industrial Sales and Manufacturing, Main Building, on or about 10/12/23 and times prior thereto: Equipment with two hand controls as the point of operation guarding were not provided with ring guards. Equipment includes but is not limited to, Dension Hydr Oil ic Multi Press ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
