29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. Located at lot 140 with an address of 63 Chambers Bay Road, Commercial Point, Ohio, 43103: On or about August 10, 2023, the employer failed to ensure that an employee operating a LULL model 644B-37 all-terrain forklift completed training and was evaluated prior to operating the equipment on the jobsite.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at Lot 140 with an address of 63 Chambers Bay Road, Commercial Point, Ohio, 43103: On or about August 10, 2023, the employer failed to ensure the employees were wearing appropriate eye protection while operating pneumatic nail gun to install the second story subflooring of a two story single family new build home.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a. Located at Lot 140 address 63 Chambers Bay Road, Commercial Point, Ohio 43103: On or about August 10, 2023, the employer failed to ensure employees working at heights over 11 feet and exposed to falls were trained to recognize the hazards of falling and the procedures to be followed to minimize fall hazards.  The following condition exposed employees to falls of 11 feet 11 inches from the second story leading edge to the ground below.

29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a. Located at lot 140 with an address of 63 Chambers Bay Road, Commercial Point, Ohio, 43103: On or about August 10, 2023, the employer failed to initiate and maintain any safety and health programs in order for their employees to identify and correct any fall and struck by hazards on the jobsite while the employees were installing subflooring material on the second story of a two story single family home. Thereby exposing the employees to falls of up to approximately 11 feet 11 inches to the ground below and struck-by hazards.  Christian Rodias was previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1616889, citation number 1, item number 1 and was affirmed as a final order on February 1, 2023, with respect to a workplace located at 8108 Rapala Lane, Pickerington, Ohio 43147.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at Lot 140 address 63 Chambers Bay Road, Commercial Point, Ohio 43103: On or about August 10, 2023, the employer failed to ensure the employees were protected from falling when the employees were unloading OSB sheathing at the leading edge of the second story landing of a two story single family home with no fall protection system's in place. The employees were exposed to a fall of approximately 12 feet from the second story leading edge to the ground below.  Christian Rodias was previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1616889, citation number 1, item number 2 and was affirmed as a final order on February 1, 2023, with respect to a workplace located at 8108 Rapala Lane, Pickerington, Ohio 43147.
