29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a) 109 West Broadway, Maple Shade NJ: Employees performing sheathing installation and other related construction activities were exposed to fall hazards of approximately 14 feet the ground surface below when working from a metal platform that was resting on the forks of a Gehl Type D all-terrain fork truck. This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform. Condition observed on or about August 11, 2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section: a) 109 West Broadway, Maple Shade NJ: An employee was permitted to work approximately 14-feet above ground level, on a scaffold platform attached to the forks of a Gehl Type D all-terrain fork truck that was not equipped with a fall protection system that meets the requirements of this section. Condition observed on or about August 11, 2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
