29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m), or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) Worksite, residential building, 3rd floor: On or about August 16, 2023, employees were conducting framing activities on the third floor of a residential building, approximately 30 feet above the ground, and were not utilizing fall protection. Employees were exposed to fall hazards.   Landsmark Construction LLLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(1), which was contained in OSHA inspection number 1590376, citation number 1, item number 1, and was affirmed as a final order on 11/10/2022, with respect to a workplace located in Newark, New Jersey.  Landsmark Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1462843, citation number 2, item number 1 and was affirmed as a final order on 5/4/2020, with respect to a workplace located in Spring Valley, New York.
