29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about August 21, 2023, at an establishment located at 2121 Richco Road in De Pere, Wisconsin; the employer did not ensure that forklifts operated in Building A were examined before being placed in service to identify any condition that could adversely affect the safety of the vehicles.

29 CFR 1910.212(a)(5): Exposure of blades. When the periphery of the blades of a fan is less than seven (7) feet above the floor or working level, the blades shall be guarded. The guard shall have openings no larger than one-half (1/2) inch. On or about August 21, 2023, at an establishment located at 2121 Richco Road in De Pere, Wisconsin; painter employees were exposed to amputation and laceration hazards created by a hole in the guard on the fan by the yellow storage container outside the paint booth.
