OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion and fire hazards of Class II explosive metal dust: a) Building 84, Vacuum Arc Remelting (VAR) - The employer failed to conduct a Dust Hazard Analysis (DHA) to identify and document the equipment and areas of the facility where combustible metal dust fire and explosion hazards exist, on or about August 5, 2023. b) Building 84, Vacuum Arc Remelting (VAR) - The employer did not provide for effective capture and control of combustible metal dust generated during grit blasting for the New Grit Blaster (Pangborn blaster, M14124), on or about August 5, 2023. c) Building 84, Vacuum Arc Remelting (VAR) - The employer did not provide for effective capture and control of combustible metal dust generated during grit blasting for the Old Grit Blaster (Pangborn blaster M12276), on or about October 24, 2023. d) Building 84, Vacuum Arc Remelting (VAR) - The employer did not provide protective measures to detect, suppress, contain and isolate combustible dust fires and/or explosions that were at risk of occurring while operating the New Grit Blaster (Pangborn blaster, M14124), on or about August 5, 2023. e) Building 84, Vacuum Arc Remelting (VAR) - The employer did not provide protective measures to detect, suppress, contain and isolate combustible dust fires and/or explosions that were at risk of occurring while operating the Old Grit Blaster (Pangborn blaster M12276), on or about October 24, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
