29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about August 24, 2023 the employer Armando Deanda DBA Deanda Roofing at jobsite located at 2229 Old Hickory Ln. Holland OH 43528, did not ensure employees were protected from falls while conducting residential roof shingling activities on the second (roof) level of a residential single-family home. Employees were exposed to a falls of approximately 15 feet and 18 feet and 4 tenths or greater to the ground below. The roof was a 6-12 pitch.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about August 24, 2023 the employer Armando Deanda DBA Deanda Roofing at jobsite located at 2229 Old Hickory Ln. Holland OH 43528, did not ensure the side rails of one base section of the portable orange fiberglass extension ladder was extended at least three feet above the landing surface. Five employees were exposed to falls from approximately 10 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform residential roofing activities.
