29 CFR 1910.38(d):Employee alarm system. An employer must have and maintain an employee alarm system. The employee alarm system must use a distinctive signal for each purpose and comply with the requirements in �� 1910.165. On or about August 24, 2023, at Swift beef facility, the employer did not have and maintain an audible general evacuation alarm system in the facility to protect its employees in the event of an Anhydrous Ammonia release, exposing employees to chemical hazard such as, but not limited too, inhalation of toxic gas.

29 CFR 1910.165(b)(2):The employee alarm shall be capable of being perceived above ambient noise or light levels by all employees in the affected portions of the workplace. Tactile devices may be used to alert those employees who would not otherwise be able to recognize the audible or visual alarm. On or about August 24, 2023, at Swift Beef facility, the employer did not implement in compliance with recognized and generally accepted good engineering practices an audible alarm to warn of chemical hazards associated with release of Anhydrous Ammonia.
