29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On August 29, 2023, at or near the 200 Block of Wall Avenue West in Horace, North Dakota, employees were exposed to cave-in hazards while installing water and sewer lines in a trench greater than 5 feet in depth with no protective systems in place.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp, or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in-depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On August 29, 2023, at or near the 200 Block of Wall Avenue West in Horace, North Dakota, employees were installing water and sewer lines in the trench at a depth of four feet or greater where no ramp was installed, and the ladder was more than 25 feet away of lateral travel and access was partially obstructed to affect a safe means of egress.
