29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On June 24, 2025, at or near the intersection of 18th Street and 32nd Avenue South in Fargo, North Dakota in the east excavation, employees were exposed to cave-in hazards while working in the area in an excavation greater than 5 feet in depth without protective systems in place. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1694818, Citation 1, Item 2, and was affirmed as a final order on December 12, 2023, with respect to a workplace located at or near 200 Block of Wall Avenue West in Horace, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, which was contained in OSHA Inspection Number 1672455, Citation 1, Item 2, and was affirmed as a final order on October 27, 2023, with respect to a workplace located at or near 988 6th Avenue North in Fargo, North Dakota.

29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On June 24, 2025, at or near the intersection of 18th Street and 32nd Avenue South in Fargo, North Dakota in the east excavation on the southwest side, employees were working in the west manhole where no ramp or ladder was installed within 25 feet of lateral travel. .
