29 CFR  1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with 29 CFR 1910.146. The written program shall be available for inspection by employees and their authorized representatives.  a) At the establishment located at 2216 Calumet Drive, New Holstein, Wisconsin; the employer did not develop and implement a written permit space program that complied with 29 CFR 1910.146, exposing an employee to the hazards associated with a permit-required confined space, such as but not limited to engulfment and thermal energy. On or about August 17, 2023, an employee entered the water tank for the boiler, a permit-required confined space, to perform maintenance or service work cleaning heat tubes in the tank.  All provisions of 29 CFR 1910.146(d) shall be contained in a written permit-required confined space program. Key elements include, but are not limited to the following: a. Procedures to identify and evaluate the hazards of permit spaces. b. Procedures for providing rescue and emergency equipment. c. Procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue.

29 CFR 1910.146(e)(1): Before entry is authorized, the employer shall document the completion of measures required by paragraph (d)(3) of 29 CFR 1910.146 by preparing an entry permit.   a) At the establishment located at 2216 Calumet Drive, New Holstein, Wisconsin; the employer did not ensure that before entry was authorized, an entry permit documenting completion of measures, such as but not limited to isolating the permit space, was prepared and completed, exposing an employee to the hazards associated with the permit-required confined space, such as but not limited to engulfment and thermal energy. On or about August 17, 2023, an employee entered the water tank for the boiler, a permit-required confined space, to perform maintenance or service work cleaning heat tubes in the tank.

29 CFR  1910.146(g)(1): The employer shall provide training so that all employees whose work is regulated by this section acquire the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this section.  a) At the establishment located at 2216 Calumet Drive, New Holstein, Wisconsin; the employer did not ensure that training was provided so that all employees whose work was regulated by the permit required confined space standard acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned, exposing an employee to the hazards associated with the permit-required confined space, such as but not limited to engulfment and thermal energy. 29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  At the establishment located at 2216 Calumet Drive, New Holstein, Wisconsin; the employer did not fully develop or implement a written hazard communication program for when employees worked with hazardous chemicals, such as but not limited to automotive diesel fuel argon gas, exposing employees to the hazards associated with automotive diesel fuel and argon gas.
