29 CFR  1910.147(c)(4)(ii)(B): The energy control procedures did not clearly and specifically outline the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.  a) 242 S. Rehoboth Blvd Milford, DE: On or about September 1, 2023, the employer did not provide a comprehensive energy control procedures to be followed by the sanitation staff in order to control hazardous energy when attempting to engage in the draining of an approximately 500 gallons of water within the tank measured at 150-degree Fahrenheit with 25 pounds of steam from this pressure vessel.  Note: An employee was attempting to open a mechanical valve at the base of this holding tank, water splattered off the wall behind the tank and onto the upper portion of the employees' body when manually opening the value. An employee developed third degree burns and was hospitalized upon opening the tank.

Rehoboth Blvd Milford, DE: On or about September 5, 2023, lack of energy control program procedure for employees who routinely operate/service hazardous equipment that involved the drainage of the clam tanks in the shucking area. It was determined that the employee(s) were not being provided effective and/or adequate training in the process of opening the drainage valve of the tank.

29 CFR  1910.147(c)(4)(ii)(D): The energy control procedures did not clearly and specifically outline the requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control:   a) 242 S. Rehoboth Blvd Milford, DE: On or about September 1, 2023, the written procedure of the employer did not clearly and specifically outline the position to open the drainage value at the base of the clam tank in the shucking area. The authorized employee attempting to drain the tank which did not have the proper control(s) concerning regulating the stored energy in the 500-gallon tank with the necessary valve and/or switch [e.g. Pneumatic] to properly direct and control its flow of water which was identified at 150-degree Fahrenheit.

29 CFR  1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed:  a) 242 S. Rehoboth Blvd Milford, DE: On or about September 1, 2023, an annual or more frequent inspections was not conducted for procedures which are necessary to the safely drain and/or flush the clam tanks at the facility. The employer did not ensure that the employees who performed servicing [e.g. draining] on the tanks followed the proper Lockout/Tagout procedure when assigned to drain the 500-gallon tank(s).    Abatement Note:  a. Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.1910.147(c)(6)(i)(D) b. Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.1910.147(c)(6)(ii) c. The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
