At an establishment located at 4852 Elm Street in Laona, Wisconsin:  a) On or about September 13, 2023, to November 1, 2023, along the south wall to the left of the emergency exit door; two 55-gallon steel drums of n-butyl acetate were stored in a manner that limited safe egress through the emergency exit door, exposing employees to fire and burn hazards.

Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.   At an establishment located at 4852 Elm Street in Laona, Wisconsin:  a) On or about September 13, 2023, to November 1, 2023, at an establishment located at 4852 Elm Street in Laona, Wisconsin: the employer did not ensure the steel, 55-gallon drum containing n-butyl acetate was grounded and bonded prior to employees pumping the category 3 flammable liquid into a 1-gallon metal can, exposing employees to fire and burn hazards.

29 CFR 1910.134(c)(2)(i): Where respirator use is not required: An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section.  At an establishment located at 4852 Elm Street in Laona, Wisconsin:  a) On or about October 27, 2023, to November 1, 2023, an employee was not provided training as outlined in the "Information for Employees Using Respirators When Not Required Under the Standard" while utilizing a Kischers 6200 half-face elastomeric respirator to protect against organic vapors and overspray while spray staining wood flooring products.   b) On or about November 1, 2023, employees were not provided training as outlined in the "Information for Employees Using Respirators When Not Required Under the Standard" while utilizing  Uline N95 respirators (Model: S-19252) to protect against overspray while spray staining wood flooring products.

29 CFR 1910.134(c)(2)(ii): Where respirator use is not required: In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  At an establishment located at 4852 Elm Street in Laona, Wisconsin:  a) On or about October 27, 2023, to November 1, 2023, the employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that an employee wearing a Kischers 6200 half-face elastomeric respirator equipped with organic vapor cartridges was medically able to use the respirator, and that the respirator was cleaned, stored, and maintained so that its use did not present a health hazard to the user.

At an establishment located at 4852 Elm Street in Laona, Wisconsin:  a) On or about September 5, 2023, to November 1, 2023, the employer did not provide training to employees regarding:   (i) how employees could detect hazardous chemicals in the work areas;  (ii) the physical hazards, health hazards and combustible dust hazards of the chemicals in their work areas;  (iii) the measures employees could take to protect themselves from hazardous chemicals through procedures and/or personal protective equipment (PPE); and  (iv) the details of a hazard communication program including descriptions of labeling on containers and safety data sheets (SDS).   Employees worked with hazardous chemicals such as, but not limited to, Barsol butyl acetate, Rubio Monocoat Smoke, Rubio Monocoat Oil Plus 2C (component A & B), Rubio Monocoat Fumed, Rubio Monocoat Oil UV (component A & B), Fremont propylene glycol, Sunnyside VM&P Naptha, combustible wood dust, and liquid petroleum gas (LPG).
