29 CFR 1910.213(g)(1): Each swing cutoff saw shall be provided with a hood that will completely enclose the upper half of the saw, the arbor end, and the point of operation at all positions of the saw. The hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters and broken saw teeth. Its hood shall be so designed that it will automatically cover the lower portion of the blade, so that when the saw is returned to the back of the table the hood will rise on top of the fence, and when the saw is moved forward the hood will drop on top of and remain in contact with the table or material being cut.  At an establishment located at 5215 Mill Road in Laona, Wisconsin:  a) On or about January 12, 2024, in Plant B, the DeWalt Miter Saw (Serial Number: 305916) was not provided with a hood that automatically covered the lower portion of the blade during the operating cycle, exposing employees to amputation hazards from the unguarded blade.

29 CFR 1910.213(s)(6): Inspection and maintenance of woodworking machinery. Emphasis is placed upon the importance of maintaining cleanliness around woodworking machinery, particularly as regards the effective functioning of guards and the prevention of fire hazards in switch enclosures, bearings, and motors.  At an establishment located at 5215 Mill Road in Laona, Wisconsin:  b) On or about January 12, 2024, in Plant B, the DeWalt Miter Saw (Serial Number: 305916) guard was not maintained in a functioning condition. While manually pulling the saw down to cut, the guard would stick, exposing employees to the lower portion of the unguarded blade.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  At an establishment located at 5215 Mill Road in Laona, Wisconsin:  a) On or about January 12, 2024, in Plant B, an employee operating a DeWalt Miter Saw (Serial Number: 305916) to cut wood was exposed to amputation hazards associated with the moving saw blade when the blade guard assembly on the saw jammed. The employer did not ensure employees implemented energy control application steps prior to allowing them to lift the blade guard to unjam the saw. The machine was not deenergized prior to the employee engaging in the servicing and maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.
