29 CFR  1926.403(b)(2): Installation and use. Listed, labeled, or certified equipment shall be installed and used in accordance with instructions included in the listing, labeling, or certification:   a- 4000 Ocean Heights Avenue, Egg Harbor Township NJ:  On or about 09/06/23 the control panel of a portable gasoline powered Ryobi 1800 generator, in use by the workers, was reconfigured by the worksite Foreman to power a flexible cord in a manner that was not listed, labeled or certified.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  a- 4000 Ocean Heights Avenue, Egg Harbor Township NJ: Due to being reconfigured by the company worksite Foreman a portable gasoline powered generator's flexible cords,  in use by the worksite workers and the company worksite Foreman, were not provided with strain relief.   Observed on or about 09/06/23.

Condition observed on or about 09/06/23.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   a- 4000 Ocean Heights Avenue, Egg Harbor Township NJ: Workers performing roofing and other related activities at the worksite were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  On or about 09/06/23 workers and the company worksite Foreman were exposed to fall hazards, in excess of 9 feet 9 inches to the ground surface below, when walking and working from a residential structure's pitched roof while not using fall protection.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a- 4000 Ocean Heights Avenue, Egg Harbor Township NJ:  The company worksite Foreman and their workers were exposed to fall hazards, up to and in excess of 9 feet 9 inches to the ground surface below, when accessing to and egressing from a pitched roof using a portable ladder whose side rails did not extend at least 3 feet above the surface being accessed/egressed. Condition observed on or about 09/06/23.
