29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    Jobsite roof: Employees, engaged in roofing work on the 10-pitch roof, are not being protected from falls of over 12-feet to the ground.  The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on September 7, 2023 when employees were installing shingles on the two-story residence at 24 Wyoming Rd. Newton, MA 02460 without fall protections and exposed to fall hazards of 12-ft 7in and up to 28-ft above ground.  Obdulio Palma DBA Palma Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1420550, citation number 2, item number1 and was affirmed as a final order on January 17, 2020, with respect to a workplace located at 226-232 Oliver St., Malden, MA 02148.

29 CFR  1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     Jobsite rear: The ladder, used by employees to access the roof, was too short to extend 3-ft beyond the roof surface and was not secured at the top. Employees were exposed to tipping/falling over 12-feet while mounting and dismounting the ladder.  The employer routinely fails to assure effective protection against tipping and/or falls as required by the standard, as demonstrated on September 7, 2023, when employees were using a ladder to access the roof of the residence at 24 Wyoming Rd. Newton, MA 02460 which was too short and unsecured and exposed to falls of over 12-feet to the ground.  Obdulio Palma DBA Palma Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1420550, citation number 1, item number 2 and was affirmed as a final order on January 17, 2020, with respect to a workplace located at 226-232 Oliver St., Malden, MA 02148.
