29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a) On September 11, 2023, employees accessed the fourth-floor balcony of an apartment building using the frame of a tubular scaffold. Employees were exposed to an approximately 35-foot fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). a) On September 11, 2023, the employer did not ensure their employee(s) were protected from fall hazards while working on a fourth-floor balcony of an apartment building prepping chicken wire for stucco application and exposed to an approximately 35-foot fall hazard. ABC Exteriors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1578119, citation number 1, item number 2a and was affirmed as a final order on 05/10/2022, with respect to a workplace located at 137 7th Ave E, Twin Falls, ID 83301. NOTE: Abatement certification and documentation are required for this item.
