29 CFR  1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about August 30, 2023 and at times prior to, an employee worked in an excavation joining pipe with tools excavator, and the spoil piles on the edge of the excavation.  The excavation had the spoil pile less than 2 feet from the wall, shovels were stored along the edge of the excavation, a tracked excavator was pared over the excavation and a backhoe was parked on the shoulder of the road within feet of the excavation.  These conditions exposed the employee to struck-by hazards as he worked in the excavation.
