29 CFR 1910.178(p)(1):  Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition:  On or about September 7, 2023, a powered industrial vehicle that was found in need of repair, remained in service. Equipment includes, but is not limited to, the Caterpillar T 80D, serial number 5AB00797, company identifier #811, which was defective in that the seat belt and horn were nonfunctional.

29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.   On or about September 7, 2023, the employer did not ensure that the Caterpillar T 80D, serial number 5AB00797,  was examined daily before being put in service. The Caterpillar T 80D had a  seat belt and horn that were nonfunctional.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):  On or about September 7, 2023, the employer did not ensure that the dip tank of Thermisol AQ Blucoat was labeled with the identity of the chemical located in the BMT area.

29 CFR  1910.1200(g)(8):The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.):  On or about September 7, 2023, employees working with chemicals such as but not limited to Thermisol AQ Blucoat  did not have safety data sheets readily accessible in their work area.

29 CFR  1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  On or about September 7, 2023, the employer did not ensue that the relocatable power tap being used in the BMT section against the wall, across from the dip tanks, was suitable for use in a commercial setting according to listing.
