29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): 34-35 Hartford Avenue: On or about September 14, 2023, the employer did not ensure that the employees were provided fall protection when they were required to work from a 1-story roof, approximately 11' above ground and a third story gambrel roof with a peak over 30' high, and a 5-12 pitch upper slope and 12-12 pitch lower slope to an approximately 20' eave and freefall distance above ground. At the time that the CO arrived, some employees were wearing incomplete fall protection harnesses and were not connected to any fall protection devices. Marco Costa LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1533924, citation number 1, item number 1, and was affirmed as a final order on October 05, 2021, with respect to a workplace located at 1 Colonial Lane, Old Saybrook, CT 06475.

These employees were not protected by protective helmets from the possible danger of head injury from impact, or from falling or flying objects. Marco Costa LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1533924, citation number 1, item number 1, and was affirmed as a final order on October 05, 2021, with respect to a workplace located at 1 Colonial Lane, Old Saybrook, CT 06475.

Employees were operating pneumatic nail guns at over 80 psi which exposed employees to eye injuries from flying debris.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. 34-35 Hartford Avenue: On or about September 14, 2023, employees were using 1x aluminum extension ladder to access the roof of the building which was measured to be 11 feet and 2x aluminum extension ladders to access the roof of the building which was measured to be 20 feet above the ground. The side rails of the ladders did not extend three feet above the landings, and there were no other hand rails provided to enable safe ingress or egress transitions between the respective ladders and the roofs.
