29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer did not certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  As of April 12, 2024, the employer had not provided abatement certification for Inspection number 1697664, which was issued on December 28, 2023, and required abatement certification for Citation 1, Item 2a and Item 2b, which were due on February 15, 2024, with respect to a work location at 193 Moody Bridge Rd, Hadley, MA 01035.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    193 Moody Bridge Rd. Hadley, MA 01035:  On or about September 14, 2023, two employees were exposed to fall hazards of approximately 11 feet above a lower level while performing residential construction work and were not protected from falling by guard rail systems, safety net systems, or a personal fall arrest system.  Sadi Gonzalez, dba Pinguin Construction LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1583887, Citation number 1, Item 1, and was affirmed as a final order on June 13, 2022, with respect to a workplace located at 260 Longmeadow St. Longmeadow, MA 01106.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  193 Moody Bridge Rd. Hadley, MA 01035: On or about September 14, 2023, the employer had not trained employees to recognize fall hazards and on the procedures to be followed to minimize these hazards, prior to exposing them to fall heights of approximately 11 feet during a residential construction project.  Sadi Gonzalez, dba Pinguin Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1583887, Citation number 1, Item 2, and was affirmed as a final order on June 13, 2022, with respect to a workplace located at 260 Longmeadow St. Longmeadow, MA 01106.

Hadley, MA 01035: On or about September 14, 2023, the employer had not prepared a written certification record of fall protection training which included the name or other identity of the person trained, the signature of the person trained, date(s) the training was completed and the signature of the person who conducted the training for two employees who were performing work on a residential roof and exposed to fall hazards of approximately 11 feet.  Sadi Gonzalez, dba Pinguin Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(b)(1), which was contained in OSHA inspection number 1583887, Citation number 1, Item 3, and was affirmed as a final order on June 13, 2022, with respect to a workplace located at 260 Longmeadow St. Longmeadow, MA 01106.
