A safe place to ride shall be provided where riding of trucks is authorized.    39 Robbins Avenue: On or about, September 19, 2023, Employees were not protected from accidental death or injury when Employer allowed Employees to ride on a telehandler Powered Industrial Truck (PIT) for which the truck was not designed or approved. Employees were observed standing on the elevated forks of a moving PIT without any fall protection or safety PPE.

29 CFR  1926.602(c)(1)(ii):   Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  39 Robbins Avenue:   On or about September 19, 2023, Employees were not protected from accidental injury while being horizontally & vertically lifted over 6' above ground by the unauthorized modification of a telehandler Powered Industrial Truck (PIT). PIT was not approved for manlifting, safety platforms, lifting carriages, or transporting any personnel but the operator.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph. The requirements applicable to construction under 29 CFR 1926.602(d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   39 Robbins Avenue: On or about, September 19, 2023, Employees were not protected from injury when Employer allowed operation of equipment or machinery by Employees that were not currently qualified or trained to operate the Powered Industrial Truck (PIT) being operated at the worksite. Employer and operator failed to provide supportive documentation that PIT operator had been properly trained or evaluated to safely operate PIT in accordance with 29 CFR 1910.178(l)(1)(i).

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  39 Robbins Avenue: On or about, September 19, 2023, Employees were not protected from accidental death or injury from falling from an unprotected side or edge which was 6 feet above ground by the use of a guardrail system, safety net system, or personal fall arrest system. Employees were working on a 1-story roof, approximately 10'-15' above ground, without any fall protection devices.
