29 CFR  1915.73(e): When employees were working near the unguarded edges of decks of vessels afloat, they were not protected by personal flotation devices meeting the requirements of 29 CFR 1915.158(a)  (a) Flat deck barge, crawler crane, without railing:  On or about 9/19/2023, and at times prior, the employer exposed employees to drowning in that a serviceable, Coast Guard approved personal flotation device was not worn while operating on a flat deck barge with unguarded edges.

29 CFR  1915.115(c)(1): The manufacturer's maximum rated safe working load for the various working radii of the boom, and the maximum and minimum radii at which the boom may be safely used with and without outriggers, was not conspicuously posted near the controls and was not clearly visible to the operator.  (a) Flat deck barge #4, Sumitomo SC 800 crawler crane:  On or about 9/19/2023, and at times prior, the employer exposed employees to roll-over hazards and drowning, in that the safe working loads for various radii of the boom were not conspicuously posted near the controls where they were visible to the operator and were instead located in a binder behind the operators seat.
