29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Jobsite garage roof 17 Suzanne Rd. Lexington, MA: The employer did not ensure that employees, engaged in roofing work from the basket of an aerial lift, were protected from fall hazards greater than 29-ft to grade. The employer routinely fails to assure effective protection against fall hazards as required by the standard, as demonstrated on or about September 26, 2023, when employees were not protected from fall and ejection hazards where fall protection was not utilized at the site at 17 Suzanne Rd. Lexington, MA, 02420. DM Construction Group, Inc, DBA DM Construction Inc. dba DM Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1622931, citation number 1, item number 1 and was affirmed as a final order on January 25, 2023, with respect to a workplace located at 36 Clarke Street, Lexington, MA 02420.
