29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  a.) On or about September 29, 2023, the employer did not ensure that powered industrial trucks including the Toyota Sit-down Forklift Truck Model: 50-8FCCU25 Serial #: 14352 and the Crown Stand-up using one or two of four probe attachment(s) that measured 16 feet and 15 feet to load geosynthetic rolls received the manufacturer's prior written approval nor did the employer ensure that the capacity, operation, tags or details had been changed accordingly.

29 CFR  1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.  a.) On or about September 29, 2023, the employer did not ensure that the non factory installed attachment, the 15-16 foot probes used on the Toyota Forklift Truck Model: 50-8FCCU25 Serial #: 14352, and the Crown stand-up forklift were marked to identify the probe attachments and to show the approximate weight of the truck and attachment combination at maximum elevation with loads laterally centered. This was last observed on October 4, 2023.

29 CFR  1910.178(m)(5)(iii): Truck operations. When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement.  a.) On or about September 29, 2023, the operator on the Toyota sit-down forklift with the 15-16 foot probe attachments dismounted the forklift within 25 feet and did not fully lower the forks after leaving the forklift parked and unattended.

29 CFR  1910.178(q)(1): Maintenance of industrial trucks. Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.  a.) On or before October 4, 2023 the Toyota sit-down forklift was not removed from service until the chain attachments for the probes had been repaired.

29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a.) On or about October 4, 2023, the employers MHE pre-trip inspection form was not being used correctly in that the chains used to secure the probes on the Toyota sit-down forklift had rings that were stretched and broken; however the inspection form utilized that morning  did not show the damage to the chains on the visual and operational checks on the form.
