29 CFR 1910.106(e)(2)(ii)(b)(1):  The employer did not ensure the quantity of liquid located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building did not exceed 25 gallons of Category 1 flammable liquids in containers.  At the location, One 55 gallon container of Acetone a Category 1 flammable liquid  was stored near exit door  outside of an inside storage room or storage cabinet. On or about October 3, 2023.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  (a) At the workplace, the Hyster Powered Industrial Truck,  Model # S155XL,  Hyster Powered Industrial truck, Model # S155XL, SN B024D05581V rated for a maximum capacity of 15,700 pounds was modified to increase the capacity to 17,000 pounds. There was no written manufacturers approval to increase the capacity. On or about October 3, 2023.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.1200(e)(1):Employer did not  implement  and maintain a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) At the workplace,   where employees are exposed to hazardous chemicals, the employer did not update the written hazard communication program to document the implementation of pictograms and accessing the company's electronic SDS library.
