29 CFR 1910.132(d) Hazard assessment and equipment selection. (1) The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; a) On or about October 3, 2023, employer's hazard assessment was inadequate in that employees who performed the train car coupling task on the Desulf tracks while standing on the ground were not provided with and required to use face protection, or mid-leg protection (knee area) to protect their face and legs from molten metal splashes and radiant heat burns.

(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) On or about October 3, 2023, the employer did not ensure that during coupling operations for torpedo railcars containing molten metal that employees were provided face protection to protect from molten splashes and radiant heat in case of event including but not limited to hard couplings.

OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) On or about October 3, 2023, on the Desulf Track, the employer did not ensure that employees who were operating the and riding on the railcar, were protected from molten metal splashes in the event of a hard coupling or collision in that the barrier on the torpedo railcar did not extend over the whole porch and stairs. b) On or about October 4, 2023, the employer did not ensure that employees were protected from molten metal splashes in the event of a hard coupling or collision in that not all torpedo railcars were equipped with barriers. The Cleveland-Cliffs Steel Corp Middletown Works was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.132(a)(1), which was contained in OSHA inspection number 1658186 citation number 1 item number 1 and was affirmed as a final order on August 16, 2023, with respect to a workplace located at 1801 Crawford Street, Middletown, OH 45044. The Cleveland-Cliffs Steel Corp Middletown Works was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.132(a)(1), which was contained in OSHA inspection number 1672202 citation number 1 item number 1 and was affirmed as a final order on August 16, 2023, with respect to a workplace located at 1801 Crawford Street, Middletown, OH 45044.
