29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: [Construction Reference 1926.103)(a)]  a) On October 5, 2023, at the above addressed jobsite, the employer did not ensure that employees using 3M half-mask respirators, each equipped with organic vapor cartridges with P100 Particulate Filters, were free of facial hair that interfered with the face-to-facepiece seal.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.451(b)(1):  Each platform on all working levels was not fully planked or decked between front uprights and the guardrail supports:     a) On October 5, 2023, at the above addressed jobsite, employees conducting tuckpointing work from a frame scaffold were exposed to fall hazards of up to approximately 12 feet where the scaffold platform was not fully decked.  No abatement certification or documentation is required for this item.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    a) On October 5, 2023, at the above addressed jobsite, an employee was exposed to fall hazards while accessing and egressing the work platform of a frame scaffold by climbing the frames.  No abatement certification or documentation is required for this item.
