On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, the employer did not initiate and maintain safety programs for employees exposed to a fall from elevation hazard and operating a powered industrial vehicle.

Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  Construction reference 1926.602(d).  On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, the employer did not provide required forklift operator training for an employee exposed to potential crushing hazards operating a JLG Skytrak 6042 Telehandler to move steel erection materials on the worksite.

29 CFR  1910.178(l)(4)(iii):  Powered Industrial Trucks.  Operator Training.  Refresher Training and Evaluation.  An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  Construction reference 1926.602(d).  On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, the employer did not ensure the JLG Skytrak 6042 Telehandler operators had current performance evaluations within the past three years.

For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, an employee was exposed to a fall hazard while working from a JLG 3246ES scissor lift 20 feet above surface level without connecting the access/egress safety chain.

The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question.  On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, the employer did not provide required scaffold training for an employee working at heights greater than six feet using a JLG 3246ES extendable platform scissor lift.

29 CFR  1926.453(b)(2)(v):  A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On or about October 3, 2023, at 2601 W 2nd Street in Appleton, Wisconsin, an employee was exposed to a fall hazard while working from a JLG telescopic boom lift 25 feet above surface level without using a required personal fall arrest system.
