29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas.  On or about October 5, 2023, employees performed masonry work in/and around an area where scrap boards with nails protruding were left on the ground in areas where employees were working. This exposed the employees to stepping on the boards and creating puncture and laceration hazards.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  On or about October 5, 2023, employees performed masonry work on a scaffold that was not fully planked, leaving a space greater than 1 inch between the platform (planks) uprights.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffolds, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access.  On or about October 5, 2023, Employees performing masonry work on the north side of the site ascended and descended the scaffold by utilizing the scaffold's bracing and frame to work at a height greater than two feet above a lower level. The scaffold lacked an appropriate means of access.

29 CFR 1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface.  On or about October 5, 2023, Employees performed masonry work from a scaffold using direct access to the building through a window. The distance between the scaffold platform and the window sill was over 14".

On or about October 5, 2023, employees were performing masonry work outside a building utilizing scaffolding that a competent person had not inspected.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section.   On or about October 5, 2023, employees worked on the top of a scaffold greater than 10 feet high without any guardrail system while erecting a cinder block wall.
