29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) New residential construction at Lot #295: On or about 10/05/2023, employees were exposed to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided while engaged in framing activities using these tools at 120 PSI.

29 CFR  1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:   a) Residential construction on Lot #295; ground floor: On 10/5/2023, the employer exposed employees to severe lacerations and/or amputation hazards, in that the Makita 7-1/4-in. Circular Saw (Model 5007F) had a non-functional guard as it did not retract immediately after the cut was made.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Residential construction Lot 295, roof: On 10/5/2023, the employer exposed employees to fall hazards of approximately 10-feet to the lower level, in that a fall protection system was not provided to employees engaged in framing activities using plywood sheathing and trusses as a walking/working surfaces.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) New residential construction at Lot #295: On 10/5/2023, the employer exposed employees to fall hazards of up to 9-feet to the lower ground level, in that a safe means of access to the upper level was not provided as employees used a 6-foot ladder to climb onto the roof.
