29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about October 10, 2023, employees using personal fall protection systems while installing shingles on a roof at heights of six (6) feet and greater were not tied off, exposing the employees to fall hazards.  Jose Landaverde-Gallegos was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1415037, citation number one (1), item number one (1) and was affirmed as a final order on August 15, 2019, with respect to a workplace located at 358 Long Meadow in The Colony, TX.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about October 10, 2023, the side rails of the ladder that employees used to access and egress the roof did not extend at least three (3) feet above the upper landing surface, exposing employees to fall hazards in the following instances (a-b):  a) One ladder on the west side of the house and,  b) One ladder on the east side of the house.  Jose Landaverde-Gallegos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1415037, citation number one (1), item number two (2) and was affirmed as a final order on August 15, 2019, with respect to a workplace located at 358 Long Meadow in The Colony, TX.
