29 CFR 1910.1200(h)(1): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(2) and (3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced in the work area: a) Trader Joe's located at 12 East State Street, Media, PA 19063 - On or about October 16, 2023, the employer failed to ensure employees received effective information/training on the hazardous chemicals in the work area and also failed to provide effective information/training at the time of employees' initial assignment. Employees are exposed to chemicals such as, but not limited to the following: -Limestone, titanium dioxide, quartz (SiO2) as contained in KILZ 2 All-purpose Primer. -Sodium dodecylbenzene sulfonate, sodium lauryl ether sulfate, sodium xylene sulfonate, magnesium sulphate, etc. as contained in Suma Pan-Clean General Purpose Pot & Pan Detergent. -etc.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years: a) Trader Joe's located at 12 East State Street, Media, PA 19063 - On or about October 16, 2023, the employer did not ensure that an evaluation of each operator's performance operating powered industrial trucks (PIT), such as but not limited to the Yale electric pallet jack, was conducted at least once every three years, thereby exposing employees to struck-by hazards. Trader Joe's was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1449648, Citation Number 1, Item Number 1 and was affirmed as a final order on March 20, 2020, with respect to a workplace located at 350 Patriots Place, Foxborough, MA 02035. Trader Joe's was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1406280, Citation Number 1, Item Number 2 and was affirmed as a final order on January 3, 2020, with respect to a workplace located at 8323 Sand Lake Road, Orlando, FL, 32819.
