29 CFR 1910.29(b)(10): The employer did not ensure that when guardrail systems are used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails: a) On or about October 16, 2023, and at times prior thereto, in the elevated work platform for Mixer #3, where production employees were exposed to fall hazards of more than 8 feet when they worked near the platform opening to a hoist area which had a single chain across the opening which did not provide the same level of safety as a standard guardrail with top rail and midrail.

29 CFR 1910.134(e)(6)(i): The employer did not obtain from the physician or other licensed health care professional (PLHCP) a written recommendation regarding the employee's ability to use the respirator: (a) On or about October 16, 2023, and at times prior thereto, in the spice mixing room, where employees handling corrosive food additives, used full face elastomeric respirators without a written recommendation from a licensed health care professional regarding the employees' ability to use the full face elastomeric respirators.
