29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about October 17, 2023, the employer Omar Rojas at jobsite located at 1610 Marketplace Dr., Maumee, OH 43537, did not ensure that each affected employee used appropriate eye or face protection when preforming roofing work on a new build residential structure while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about October 17, 2023, the employer Omar Rojas at jobsite located at 1610 Marketplace Dr., Maumee, OH 43537, did not ensure employees were protected from falls while conducting commercial roofing construction activities on the second (roof) level of a new build residential multi-family building, while exposed to falls of between approximately 9 and 13 feet or greater to the ground below. Employees were working atop a steep roof with a 4:12 pitch at the peak of the garage roof peak.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about October 17, 2023, the employer Omar Rojas at jobsite located at 1610 Marketplace Dr., Maumee, OH 43537, did not ensure the side rails of one aluminum extension ladder was extended at least three feet above the landing surface. Two employees were exposed to falls from approximately 9 feet or greater from the top of the second (roof) level to the ground below while using the ladder to access the second (roof) level to perform residential roofing activities on a multi-family building.
