Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems: On or about October 19, 2023, employees of Jose Ojeda, dba: Spartan Roofing were performing roofing work at 512 Forest Park Drive in Wentzville, Missouri. The employer did not ensure that fall protection was utilized by employees working on the roof of the building. The employees did not utilize guardrail systems, a safety net system, or a personal fall arrest system, exposing themselves to fall hazards of approximately 10.5 feet and greater.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: On or about October 19, 2023, employees of Jose Ojeda, dba: Spartan Roofing were performing roofing work at 512 Forest Park Drive in Wentzville, Missouri. A ladder was used by employees for access and egress to the roof. The side rails of the ladder did not extend 3 feet above the upper surface, exposing employees to fall hazards.
