29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 27, 2023, Jose Ojeda DBA Spartan Roofing did not ensure that each employee operating a pneumatic nail gun utilized appropriate eye protection when exposed to eye hazards from flying particles in a worksite at 1791 Fairview Farms Circle in Wentzville, Missouri.

29 CFR  1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On or about October 27, 2023, Jose Ojeda DBA Spartan Roofing did not ensure that a portable ladder used to access the roof of a residential building at 1791 Fairview Farms Circle in Wentzville, Missouri, was extended at least 3 feet above the upper landing surface, exposing employees to fall hazards.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net system, or personal fall arrest system.  On or about October 27, 2023, Jose Ojeda DBA Spartan Roofing did not ensure that each employee roofing a residential building at 1791 Fairview Farms Circle in Wentzville, Missouri, was protected by personal fall arrest systems. Employees were exposed to falls from heights greater than 10 feet.  Jose Ojeda DBA Spartan Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1693136, citation number 1, item number 1 and was affirmed as a final order on October 25, 2023, with respect to a workplace located at 524 Meadow Field Lane in Wentzville, Missouri.

On or about October 27, 2023, Jose Ojeda DBA Spartan Roofing did not develop, implement, and maintain at each workplace a written hazard communication program which at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for SDSs, and (h) for employee information and training would be met.
