29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  On or about October 19, 2023, employees of Hector Vasquez, dba: Hector Vasquez were performing roofing work at 236 Burrograss Drive in Wentzville, Missouri. The employer did not ensure eye protection was utilized by employees operating Metabo HPT NV45AB2 pneumatic nail guns.  Employees were exposed to struck-by hazards.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  On or about October 19, 2023, employees of Hector Vasquez, dba: Hector Vasquez were performing roofing work at 236 Burrograss Drive in Wentzville, Missouri. The employer did not ensure that fall protection was worn while work was being performed on the roof approximately 22 feet above the lower level.  The employees were exposed to fall hazards.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about October 19, 2023, employees of Hector Vasquez, dba: Hector Vasquez were performing roofing work at 236 Burrograss Drive in Wentzville, Missouri. The employer did not provide training to each employee on how to recognize and minimize hazards associated with falling. Employees were not able to identifying hazardous conditions while working at elevation. Employees were exposed to the hazard of falling while working on an 8:12 pitch roof at heights of approximately 22 feet above the lower level.

29 CFR 1926.1053(b)(15): Ladder(s) were not inspected by a competent person for visible defects on a periodic basis and/or after an occurrence that could have affected their safe use:   On or about October 19, 2023, employees of Hector Vasquez, dba: Hector Vasquez were performing roofing work at 236 Burrograss Drive in Wentzville, Missouri. The employer did not ensure the extension ladder used by employees was inspected by a competent person.  The ladder had illegible markings, damage to the rungs and bent side rail causing a foot to bend inwards.  Employees were exposed to fall hazards while using a ladder with visual defects.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:    On or about October 19, 2023, employees of Hector Vasquez, dba: Hector Vasquez were performing roofing work at 236 Burrograss Drive in Wentzville, Missouri. The employer did not protect employees from fall hazards while carrying large, heavy, and awkward materials up an extension ladder.  An Employee was carrying a roof shingle bundle weighing approximately 70 pounds and measuring 39.38 inches long by 13.25 inches wide.  The employee was exposed to fall hazards of approximately 12 feet to the ground below.
