29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about October 23, 2023, there was evidence of a situation that the competent person failed to recognize that could have resulted in a cave-in on a jobsite located at 1636 Snow Road Parma, Ohio 44134, where 02 employees were directly exposed to and not removed from a trench 6.9-feet below the ground without any form of cave-in protection.

1926.651(j)(1) Adequate protection shall be provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection. On or about October 23, 2023, employees while working within a trench 6.9 feet below the ground on a jobsite located at 1636 Snow Road Parma, Ohio 44134, were exposed to a cave-in hazard and not protected by an adequate protective system. Fabrizi Trucking & Paving Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1352668, citation number 1, item number 1 and was affirmed as a final order on December 18, 2018, with respect to a workplace located at901 Cleveland Street, Elyria, Ohio.
