29 CFR  1926.300(b)(4)(ii): The point of operation of machine(s) whose operation exposed an employee to injury was not guarded:   a)  On 10/19/2023, at the job site 15631 Lynch Road, in Albion, New York, the employer did not enforce the use of machine guarding to protect employees exposure to the mixing paddles of a cement mixer.  Employees were exposed to fractures and laceration injuries when working around an unguarded cement mixer.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a) On 10/19/2023,  where an employee suffered a fracture of his right arm from contact with the  mixing paddles of a cement mixer. The employer did not notify the Occupational Safety and Health Administration (OSHA), of the employee's hospitalization within 24 hours.  OSHA became aware of this from a referral source on 10/24/2023.  NO ABATEMENT CERTIFICATION REQUIRED
