On or about October 24, 2023, the employer failed to establish and implement those elements of a written program necessary to ensure that employees using respirators voluntarily were medically able to use that respirator when  employees using tight fitting half-face respirators on a voluntary basis when using cleaning chemicals during the sanitation shift were not provided medical evaluations.
