29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) On or about October 25, 2023 at the Mezzanine loading dock of the warehouse: employees were exposed to fall hazards of 9 feet 6 inches while retrieving and storing merchandise from the second level of the mezzanine, in that fall protection was not used.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) On or about October 25, 2023, at the warehouse, employees were exposed to slip and fall hazards, in that, employees were required to walk and work in passageways and other areas containing accumulated merchandise, trash and empty boxes.
