29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  On or about October 19, 2023, employees of Jose Ortiz were performing roofing work at 415 Van Buren Court in Wentzville, Missouri.   Pneumatic nail guns were being used by an employee without donning eye protection. The employees were exposed to struck-by hazards from ricochets and flying debris.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  On or about October 19, 2023, employees of Jose Ortiz were performing roofing work at 415 Van Buren Court in Wentzville, Missouri.  The employer did not ensure that workers on the roof approximately 11 feet above the lower level were protected by a fall protection system.  The employees did not utilize guardrail systems, a safety net system, or a personal fall arrest system exposing themselves to fall hazards.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  On or about October 19, 2023, employees of Jose Ortiz were performing roofing work at 415 Van Buren Court in Wentzville, Missouri.  A ladder was placed on the East side of the residence for access and egress to the roof. The side rails of the ladder did not extend 3 feet above the upper surface.

The employer did not ensure the ladder used by employees was inspected by a competent person.  The ladder had illegible markings, damage to the structure and locking mechanism exposing employees to fall hazards.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards:  On or about October 19, 2023, employees of Jose Ortiz were performing roofing work at 415 Van Buren Court in Wentzville, Missouri. The employer did not provide a training program for the use of ladders.  Employees at the jobsite were incorrectly using a damaged extension ladder to access the roof to perform work.
