29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  The employer is failing to protect employees from eye hazards due to flying particles. The condition was most recently observed on or about October 27, 2023, when 1 employee was observed operating pneumatic nail guns at 569 Crystal Stream Drive in Wentzville, Missouri. The employer did not ensure that each affected employee used appropriate eye protection. The employee was observed operating a pneumatic nail gun without eye protection and thus was exposed to eye hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it was infeasible or created a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about October 27, 2023, when 3 employees were observed working on a roof at 569 Crystal Stream Drive in Wentzville, Missouri. The employer did not utilize guardrail systems, a safety net system, or a personal fall arrest system. The employees were observed on the roof of the building, at heights of greater than 10 feet, without fall protection and thus exposed to falls to the ground below.  H R Vasquez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1556628, citation number 1, item number 1 and was affirmed as a final order on March 8, 2022, with respect to a workplace located at 1006 Regency Manor Drive in Ballwin, Missouri.  H R Vasquez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1607793, citation number 1, item number 1 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 1633 Kehrs Mill Road in Chesterfield, Missouri.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface, and the ladder's length allowed, the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access.  The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about October 27, 2023, when 3 employees were observed working on a roof at 569 Crystal Stream Drive in Wentzville, Missouri. The employer did not ensure that where portable ladders were used for access to an upper landing surface, and where the ladder's length allowed, the ladder's side rails were extended at least 3 feet (.9m) above the upper landing surface being accessed. The ladder the employees used to access the roof was extended approximately 0.5 feet beyond the upper landing, or edge of the roof, thus exposing employees to fall hazards.  H R Vasquez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1556628, citation number 1, item number 2 and was affirmed as a final order on March 8, 2022, with respect to a workplace located at 1006 Regency Manor Drive in Ballwin, Missouri. 29 CFR  1926.59: The employer did not develop a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  The employer is failing to protect employees from chemical hazards. The condition was most recently observed on or about October 27, 2023, when 4 employees were observed working at 569 Crystal Stream Drive in Wentzville, Missouri. Gasoline was present at the worksite and used by employees to power air compressors for pneumatic nail guns. A safety data sheet for gasoline was not present on site, nor did the employer have a written hazard communication program, thus exposing employees to chemical hazards.
