29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  The employer is failing to protect employees from eye hazards due to flying particles. The condition was most recently observed on or about November 2, 2023, when two employees were observed operating pneumatic nail guns at 215 Brookstone Creek Drive in Wentzville, Missouri. The employer did not ensure that each affected employee used appropriate eye protection. The employees were observed operating pneumatic nail guns without eye protection and thus exposed to eye hazards.

29 CFR 1926.501(b)(13): "Residential construction." Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about November 2, 2023, when five employees were observed working on a roof at 215 Brookstone Creek Drive in Wentzville, Missouri. The employer did not utilize guardrail systems, a safety net system, or a personal fall arrest system. The employees were observed on the roof of the building without fall protection at heights at least as high as 9 feet from ground-to-eave, as measured along the east garage roof.  H R Vasquez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1556628, citation 1, item number 1 and was affirmed as a final order on March, 8, 2022, with respect to a workplace located at 1006 Regency Manor Drive, Ballwin, Missouri.  H R Vasquez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1607793, citation number 1, item number 1 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 1633 Kehrs Mill Road, Chesterfield, Missouri.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about November 2, 2023, when five employees were observed working on a roof at 215 Brookstone Creek Drive in Wentzville, Missouri. The employer did not ensure that where portable ladders were used for access to an upper landing surface, and where the ladder's length allowed, the ladder's side rails were extended at least 3 feet (.9m) above the upper landing surface being accessed. The ladder the employees used to access the roof was extended approximately 10 inches beyond the upper landing, or edge of the roof, thus exposing employees to fall hazards.  H R Vasquez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1556628, citation 1, item number 2 and was affirmed as a final order on March 08, 2022, with respect to a workplace located at 1006 Regency Manor Drive, Ballwin, Missouri.  H R Vasquez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1607793, citation number 1, item number 2 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 1633 Kehrs Mill Road, Chesterfield, Missouri.
