29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 30, 2023, A&Y Roofing LLC did not ensure that at least 2 employees had used appropriate eye protection when exposed to eye hazards from flying particles while operating pneumatic nail guns in a worksite at 302 Van Buren Drive in Wentzville, Missouri.

On or about October 30, 2023, A&Y Roofing LLC did not ensure that 4 employees roofing a residential building at least 10 feet above the lower level had been protected by guardrail systems or personal fall arrest systems.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about October 30, 2023, A&Y Roofing LLC did not provide training for employees who were exposed to fall hazards from roofing a residential building at 302 Van Buren Drive in Wentzville, Missouri. Employees were not trained to recognize the hazards of falling and the procedures to be followed in order to minimize fall hazards.

29 CFR  1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access.  On or about October 30, 2023, A&Y Roofing LLC did not ensure that a ladder used to access the roof of a residential building in a worksite at 302 Van Buren Drive in Wentzville, Missouri was extended at least 3 feet above the upper landing surface.

29 CFR  1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about October 30, 2023, A&Y Roofing LLC did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraph (f) for labels and other forms of warnings, (g) for SDSs, and (h) for employee information and training would be met. The chemical gasoline was used by employees to power air compressors for pneumatic nail guns.
